Terms of Service

DearSomeone is a service for writing real letters — composed thoughtfully, printed on paper, and delivered by post. These Terms of Service ("Terms") govern your access to and use of the DearSomeone website, apps, and related services (together, the "Service").

By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use DearSomeone.

To use DearSomeone, you must:

• be at least 16 years old;
• if you are between 16 and 17, have consent from a parent or legal guardian;
• be located in India — the Service is currently available only within India;
• use the Service as an individual — accounts are intended for personal use, not organisations or automated systems.

When you create an account, you are responsible for:

• providing accurate and up-to-date information;
• keeping your credentials — including passwords and any linked sign-in providers — confidential and secure;
• all activity that occurs through your account.

If you believe your account has been accessed without your permission, please contact us immediately. We may suspend or restrict accounts that violate these Terms.

Consent is at the heart of DearSomeone. A letter will never be delivered to someone who has not agreed to receive it.

• Recipients decide, for themselves, whether they wish to accept correspondence from you.
• If a recipient declines, the letter is not delivered.
• The sender is informed only that delivery was not accepted — never why, and never anything the recipient did not choose to share.
• Recipient privacy is protected at every step, including handles, addresses, and prior consent history.

When you send a letter through DearSomeone, you are responsible for:

• the content of the letter you submit;
• the accuracy of any recipient information you provide;
• the delivery instructions attached to the letter.

You confirm that you have the right to provide any recipient information you enter, and that doing so does not violate the privacy, safety, or dignity of the person you are writing to.

DearSomeone supports anonymous letters, because sometimes the most honest words are the ones without a name attached. Anonymity is a privilege, and it comes with responsibilities.

Anonymous letters are permitted only if they comply with these Terms and our Community Guidelines. Anonymous communication must never be used to:

• harass, bully, or intimidate;
• threaten harm to any person;
• impersonate someone else;
• deceive the recipient about who is writing;
• commit fraud or facilitate any unlawful act.

Misuse of anonymity is a serious violation and may result in suspension, termination, and — where warranted — cooperation with lawful authorities.

Future Me letters are letters you write to yourself, held safely inside your account and delivered on a date you choose.

Until delivery, Future Me letters remain associated with your account. You can edit them, reschedule them, or delete them at any time. If you delete your account before the scheduled date, the letter is deleted with it.

DearSomeone runs on credits. Certain actions — such as sending a printed letter — require credits to be available in your mailbox before they can proceed.

• Credits may be purchased in bundles from within the Service.
• Where a recipient declines a letter and no fulfilment cost has been incurred, credits may be restored to your account.
• Credits are generally non-refundable, except where a refund is required by applicable law.
• Credits have no cash value outside the Service and cannot be transferred between accounts unless we explicitly enable this.

Payments are processed by authorised third-party payment providers on their own secure infrastructure. We do not store complete payment card numbers.

You may cancel an eligible order before fulfilment has begun. Once a letter enters printing or dispatch, cancellation may no longer be possible.

If credits have already been consumed for a letter, cancellation does not automatically entitle you to a credit refund unless a refund is required by applicable law or explicitly offered by us in the circumstances.

Letters are printed in-house, with care, by DearSomeone.

• Production begins after all required conditions are satisfied, including recipient consent, safety review, and available credits.
• Delivery timelines shown in the Service are estimates and depend on courier and postal partners.
• Unexpected delays may occur due to weather, transport, or events outside our reasonable control.
• Letters that cannot be delivered may be returned to DearSomeone. Where possible, we will notify you and, where appropriate, restore associated credits.

When you use DearSomeone, you agree not to use the Service to engage in or facilitate any of the following:

• any activity that is illegal under applicable law;
• harassment, bullying, stalking, or intimidation;
• threats of violence or harm to any person or group;
• hate speech or content that incites hatred or discrimination;
• impersonation of another person or entity;
• scams, fraud, or deceptive schemes;
• distribution of malware or other harmful code;
• unsolicited bulk messaging or spam;
• infringement of intellectual property rights;
• misuse of recipient information, including sharing, harvesting, or re-selling;
• attempts to bypass, disable, or interfere with platform safeguards, rate limits, or security controls.

Before a letter is printed and dispatched, automated systems may review its content for a narrow, specific purpose: to detect material that would cause real harm if delivered.

The review looks only for:

• abuse, harassment, and threats;
• scams and fraudulent content;
• illegal content;
• clear violations of our Community Guidelines.

This exists to protect recipients and the integrity of the Service. The results are not used for advertising, profiling, or any purpose unrelated to platform safety.

You retain ownership of the letters you write. The words are yours.

DearSomeone retains ownership of the Service itself, including our branding, trademarks, website, software, platform design, and underlying technology.

By submitting a letter through DearSomeone, you grant us only the limited rights necessary to operate the Service — to store, process, print, and deliver the letter on your behalf. We do not use the content of your letters for marketing, advertising, or model training.

We may suspend, restrict, or terminate accounts that:

• violate these Terms or our Community Guidelines;
• abuse the platform or its users;
• attempt fraud or misuse of credits, payments, or refunds;
• create meaningful safety risks for recipients or the public.

Where possible, we will explain the reason and give you an opportunity to respond. In urgent situations we may act first and explain afterwards.

We work hard to keep DearSomeone reliable, but we cannot guarantee uninterrupted availability. Maintenance windows, updates, or events outside our control may temporarily affect the Service.

We will do our best to communicate planned downtime in advance and to resolve unplanned issues quickly.

DearSomeone is provided on an "as available" basis. To the fullest extent permitted by applicable law, DearSomeone and its team are not liable for indirect, incidental, special, or consequential losses arising out of your use of the Service — including lost profits, lost opportunities, or loss of data.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

You remain responsible for the content you submit through DearSomeone. If a third party brings a claim against us because of content you submitted that is unlawful, infringing, or in breach of these Terms, you agree to indemnify us against reasonable losses arising directly from that claim, to the extent permitted by law.

These Terms are governed by the laws of India.

If a dispute arises, we ask that you first contact us so we can try to resolve it directly. If we cannot resolve it that way, the dispute should be referred to arbitration in accordance with applicable Indian law.

Where court proceedings become necessary, the courts located in Coimbatore, Tamil Nadu shall have jurisdiction, subject to applicable law.

As DearSomeone grows, these Terms may be updated to reflect changes in the Service, our practices, or the law. When we make material changes, we will communicate them appropriately — through the website, your account, or email — and update the "Last Updated" date at the top of this page.

Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
